What Does This Notice Cover

This Privacy Information explains how we at Jem Brooks use your personal data: how it is collected, how it is held, and how it is processed. It also explains your rights under the law relating to your personal data.

What is Personal Data?

Personal data is defined by the General Data Protection Regulation (EU Regulation 2016/679) (the “GDPR”) as ‘any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier’.

Personal data is, in simpler terms, any information about you that enables you to be identified. Personal data covers obvious information such as your name and contact details, but it also covers less obvious information such as identification numbers, electronic location data, and other online identifiers.

Collection of Information We collect personal information, like names, postal addresses, email addresses, etc., when voluntarily submitted by our visitors. This information is only used to fulfill your specific request, unless you give us permission to use it in another manner, for example, to add you to one of our mailing lists.

Sensitive Data Any sensitive data, such as medical information, that you have submitted, will be destroyed after the end of our coaching relationship with you. All related emails and website forms will be removed and destroyed in a reasonable and safe manner.

Your Account All online product and course customers must create an account and associated log-in credentials. You agree to provide true, accurate and current information when creating an account, and you are responsible for updating your account information as needed to ensure it remains current. You are responsible for maintaining the confidentiality of your log-in credentials, and you hereby acknowledge and agree that you are fully responsible and liable for all usage and activities that occur under your account, whether authorised by you or not. You agree to notify Jem Brooks immediately if you know of or suspect any unauthorised use of your account or password or any other breach of security related to your account. Notwithstanding anything to the contrary in these Terms, Jem Brooks reserves the right to deny the creation of, suspend access to or terminate any account(s), or to remove or modify content, features, functionalities and/or services available to account holders, at any time in its sole discretion and without prior notice or liability to you.

What Are Your Rights 

Under the GDPR, you have the following rights, which we will always work to uphold:

a) The right to be informed about our collection and use of your personal data. 

b) The right to access the personal data we hold about you. 

c) The right to have your personal data rectified if any of your personal data held by us is inaccurate or incomplete. 

d) The right to be forgotten, i.e. the right to ask us to delete or otherwise dispose of any of your personal data that we have. 

e) The right to restrict (i.e. prevent) the processing of your personal data.

f) The right to object to us using your personal data for a particular purpose or purposes.

g) The right to withdraw consent. This means that, if we are relying on your consent as the legal basis for using your personal data, you are free to withdraw that consent at any time.

h) The right to data portability. This means that, if you have provided personal data to us directly, we are using it with your consent or for the performance of a contract, and that data is processed using automated means, you can ask us for a copy of that personal data to re-use with another service or business in many cases.

i) Rights relating to automated decision-making and profiling. We do not use your personal data in this way.

It is important that your personal data is kept accurate and up-to-date. If any of the personal data we hold about you changes, please keep us informed as long as we have that data.

Email Marketing Under the GDPR, we use the lawful basis of consent for anyone subscribing to our newsletter or marketing mailing list. Any email marketing messages we send are done so through an EMS, email marketing service provider. 

Email marketing messages that we send may contain tracking beacons / tracked clickable links or similar server technologies in order to track subscriber activity within email marketing messages. Where used, such marketing messages may record a range of data such as; times, dates, I.P addresses, opens, clicks, forwards, geographic and demographic data. Such data, within its limitations, will show the activity each subscriber made for that email campaign.

Any email marketing messages we send are in accordance with the GDPR and the Privacy and Electronic Communications Regulations (PECR).

We provide you with an easy method to withdraw your consent (unsubscribe) or manage your preferences / the information we hold about you at any time. See any marketing messages for instructions on how to unsubscribe or manage your preferences.

We will not share or sell any of your data, (such as your email address) to any 3rd parties unless we gain express written consent.


Sharing DataWe will not share any of your personal data with any third parties for any purposes, subject to one important exception.

Cookie/Tracking Technology This website may use cookie and tracking technology depending on the features offered. Cookie and tracking technology are useful for gathering information such as browser type and operating system, tracking the number of visitors to the Site, and understanding how visitors use the Site. Cookies can also help customise the Site for visitors. Personal information cannot be collected via cookies and other tracking technology; however, if you previously provided personally identifiable information, cookies may be tied to such information. Aggregate cookie and tracking information may be shared with third parties.

 

Changes to this Privacy NoticeWe may change this Privacy Notice from time to time. This may be necessary, for example, if the law changes, or if we change our business in a way that affects personal data protection.
